ELMHURST MAN CONVICTED OF KILLING MOTHER AND BROTHER

Queens District Attorney Melinda Katz announced that Roscoe Danielson was convicted of murder in the second degree, concealment of a human body and multiple other charges for killing both his mother and brother in the East Elmhurst home they shared in July 2023. The defendant dragged a garbage bag concealing the body of his brother from the home to a nearby curb. The remains of his mother were found inside their residence.

District Attorney Katz said: “The defendant violently murdered his mother and brother and then cruelly attempted to dispose of his brother’s body in the trash. This was a completely senseless crime that will affect the family members and friends of Cheryl Myrick and Kyle Danielson for years to come. The defendant now faces up to 50 years to life for the heinous crimes when he is sentenced on October 27.”

Danielson, 42, previously of 104th Street in East Elmhurst, was found guilty yesterday following a two-week trial. He was convicted of two counts of murder in the second degree, two counts of criminal possession of a weapon in the second degree, four counts of tampering with physical evidence, two counts of criminal possession of a weapon in the fourth degree, concealment of a human corpse and endangering the welfare of a child.

Trial openings began on September 10 and closing arguments took place on September 24. The jury deliberated for three hours before reaching a verdict.

Queens Supreme Court Justice Kenneth Holder, who presided at trial, set sentencing for October 27. At that time, Danielson faces up to 50 years to life in prison.

According to the charges and trial testimony, on July 5, 2023, at approximately 8:18 a.m., the defendant dragged a large black garbage bag along 104th Street in East Elmhurst and left it on the curb in front of 32-41 104th Street.

Later that day, at approximately 2 p.m., police responded to the location after receiving a report of a foul odor coming from the trash bag. Responding officers opened the bag and found the decomposing body of 31-year-old Kyle Danielson — Roscoe Danielson’s brother — wrapped in plastic bags and blankets.

Kyle Danielson was shot in the torso and suffered approximately 50 stab wounds to his head, neck and chest.

The defendant was apprehended after being spotted at approximately 8 p.m. on July 5, 2023, pushing his young son in a stroller with a black back hanging from the handle. He was taken into custody and following a court-authorized search of the stroller and bag, a 9 mm handgun and a knife were found.

Police executed a court-authorized search warrant at Danielson’s home at approximately 2:30 a.m. on July 6 and found the decomposing body of Danielson’s mother, Cheryl Myrick, in a second-floor bedroom.

Myrick died as a result of being stabbed roughly 38 times in her neck and torso. Both victims were killed on July 4, 2023, according to trial records.

Assistant District Attorneys Kenneth Zawistowski, of the District Attorney’s Homicide Bureau, prosecuted the case, under the supervision of Assistant District Attorneys John Kosinski, Bureau Chief, and Karen Ross and Jonathan Selkowe, Deputy Bureau Chiefs, and under the overall supervision of Executive Assistant District Attorney for Major Crimes Shawn Clark.
